Terms and Conditions Last updated: [●] Welcome to Qawafel Alsahra Gateway. By registering on or using our app or website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform. Key points you need to know • Your bids are binding and cannot be withdrawn once placed. • You cannot bid until you pay the advance deposit and receive your bidding card. • If you win a lot, you must pay the full amount due within 15 hours. • If you do not pay on time, the sale is cancelled and the full deposit (20% of the price) is forfeited. • The seller is Qawafel Alsahra Auctions Company; we are the electronic bidding channel.
Eligibility and Account Creation
You must be of legal age to conduct transactions and have legal capacity. You must provide accurate and up-to-date information. We use OTP verification via SMS or WhatsApp to verify your phone number. You are responsible for keeping your login details confidential and for any activity under your account.
Acceptance of Terms
By using the Qawafel platform (website or app), you acknowledge that you have read these terms and agree to comply with all related rules and policies, including the privacy policy.
Seller Obligations in Offers
Accuracy of information and images, ownership of the animal, and freedom from third-party claims. Disclosure of any material defects and provision of necessary documents. Commitment to deliver to the buyer according to the agreed description and price.
General terms
• Account suspension: We may suspend or close your account if you breach these Terms or the law, or at the request of a competent authority. You may close your account at any time. This does not cancel your obligations for earlier bids or sales. • Notices: Notices sent through the app, by SMS or to your registered email are deemed received when sent. • Changes: We may amend these Terms and will notify you [7] days before any change takes effect. Changes do not apply to an auction where bidding has started or to a sale concluded before they take effect. • Governing law: These Terms are governed by the laws of the Kingdom of Saudi Arabia, including the regulations and controls issued by the Ministry of Environment, Water and Agriculture on camel trading. Any dispute will be settled amicably within [15] days, failing which the competent court in Riyadh will have jurisdiction. • Evidence: The Platform's records are conclusive evidence of bids, acceptances and payments unless proven otherwise. • If any provision is held invalid, the remaining provisions remain in force. • The Arabic text prevails in case of any difference with the English version. • Contact us: [email] – [phone number] Acceptance text at registration ☐ I have read and agree to the Terms and Conditions and the Privacy Policy.
Our responsibility
• We do our best to keep the Platform available, but we do not guarantee uninterrupted service. • If a material technical fault occurs during an auction, we may pause, extend, restart or cancel it, and will notify participants. • We are not responsible if your bid is not registered because of your connection or device. • If it is established by a final judgment or conclusive liability that technical faults on the Platform caused direct damage to a user, the Platform's maximum financial liability to any user shall in no event exceed the advance deposit paid by that user for the same auction, and the Platform bears no loss of profit or indirect damage arising from service interruption or system failure. • We are not responsible for the obligations of the Seller or the buyer under the sale contract, or for indirect damage or loss of profit. • Our financial liability to you is limited to refunding any amount we received from you without entitlement and have not passed to the Seller. • These limits do not apply in cases of fraud or gross negligence. • You will compensate us for any loss or claim arising from your breach of these Terms
. Your data and privacy
• We process your data in accordance with the Personal Data Protection Law and our Privacy Policy. • We share your data only as necessary with: the Seller to complete the sale; the Ministry to transfer ownership and record auction data; payment and transport providers; and competent authorities on request. • We may record auctions and related calls and messages, and keep them as evidence
What is not allowed
• Posting misleading or offensive content. • Using the Platform for any unlawful or fraudulent purpose, or bidding for someone else without an approved power of attorney. • Interfering with the Platform, sending malicious software, or attempting reverse engineering. • Collecting other users' data, or copying and republishing Platform content. • Impersonating others, or using the name of any government body without permission. • The Platform's content, trademarks, logos and software are owned by or licensed to us and may not be used without our written permission.
Camel welfare
• Follow animal welfare rules at auction sites: do not disturb or provoke the camels, keep a safe distance, and keep the area clean. • We may remove anyone who breaches these rules and report any animal abuse or suspected contagious disease to the Ministry.
Delivery and defects
• The Seller is responsible for transferring ownership to you with the Ministry after full payment, and will issue a delivery permit subject to that transfer. • Collect your camels from the delivery location within the set period. You bear the costs of transport, registration and microchip renewal, and must transport them in a licensed vehicle in line with Ministry instructions. • If the buyer fails to collect the camels after the collection period ends, the risk of loss passes to the buyer immediately, and the buyer bears the actual and fixed costs of feeding and caring for the camels at SAR 500 per day of delay. The Seller may deduct these costs from any amounts paid in advance. • You accept the camels in their visible condition and as disclosed on their listing card. You may object to the Seller regarding a hidden defect, illness or material mismatch with the listing card within [48] hours of delivery, supported by a report from a licensed veterinarian. • Full delivery and defect terms are set out in the Auction Sale Terms for each auction, which prevail in case of any difference.
Camels on offer
• For each lot, the Seller provides a listing card showing sex, breed and colour, the information supplied by the Seller, and recent photos and video. • The Seller alone is responsible for the accuracy of the camels' details, their ownership and their condition, and warrants them free from hidden defects and disease at delivery. • Our review of documents before listing is a documentary check only and is not a guarantee of the camels' condition. • The Seller may not bid on its own camels, directly or through others. • The Platform is not responsible for the accuracy of listing information, as it is provided by the Seller.
. After you win: payment and default
• You will receive an instant notice of the price, commission, VAT and payment deadline. • You have 15 hours from the award to pay the full amount due: the price, the commission and VAT, less your advance deposit. • Topping up the deposit to 20%: through the Platform, or by transfer to the Seller's account. • The balance: by bank transfer to the Seller's account stated in the Auction Sale Terms only. • Cash payments are not accepted, and neither we nor the Seller are responsible for any amount transferred to another account. • You pay no fees to the Platform; our fees are paid by the Seller. • If you do not pay within 15 hours: the Seller may cancel the sale without notice, the deposit (20% of the price) is forfeited, and any part of it you have not paid remains a debt owed by you, in addition to the other consequences set out in the Auction Sale Terms. We may also suspend your account or require a higher advance deposit in future auctions. • Any bank transfer is valid only if made from a bank account officially registered in the buyer's own name. Neither the Platform nor the Seller accepts transfers from third-party accounts, and the buyer alone bears responsibility for any delay in, or invalidity of, payment made in breach of this. • If the buyer fails to collect the camels for more than [3] days after the end of the collection period, the Seller may, after sending an electronic warning to the buyer, sell the camels at a new auction for the buyer's account, recover upkeep costs and any damage or price differences from the sale proceeds, and hand over any remaining balance to the buyer, or treat the camels as abandoned in accordance with applicable regulations.
How bidding works
• Every bid you place is binding and cannot be withdrawn. It lapses only if someone places a higher bid. • Each auction sets its opening price, minimum bid increment and closing time. • In hybrid auctions, bids from the floor and from the app are treated equally, and the Platform's record is final. If two bids are equal, the earlier one prevails. • If you use automatic bidding, the maximum you set authorizes us to bid on your behalf up to that amount. • A lot is awarded to the highest bid that meets the Seller's reserve price, which may not be disclosed. The sale between you and the Seller is concluded at the moment of award. • Collusion between bidders, fake bidding and the use of unapproved automated tools are prohibited. We may cancel any bid or award shown to be linked to them.
Advance deposit and bidding card
• Before bidding in any auction, you must complete identity verification, accept the Auction Sale Terms, and pay the "advance deposit" through the Platform. You will then receive an electronic "bidding card". No bid is accepted without it. • The minimum advance deposit is set for each auction, and we may link your maximum bid to the amount of your advance deposit. • If you do not win any lot, we will refund your advance deposit in full within [3] business days after the auction ends, to the same payment method. • If you win a lot, your advance deposit is counted toward the deposit of 20% of the price
Your account
• Registration is open to individuals aged 18 or over with full legal capacity. • Register with your real name, national ID or Iqama number, and a mobile number registered in your name. We may verify your identity through Nafath. • Only one account is allowed per person. You are responsible for keeping your details accurate and up to date. • You are responsible for everything done through your account. Keep your login details confidential and tell us immediately if you suspect unauthorized use. • Bidding on behalf of someone else: You may bid as an agent for another person under a valid, notarized power of attorney that authorizes you to bid, buy, pay and take delivery
Who we are
• Qawafel Alsahra Gateway is an electronic platform operated by [Qawafel Alsahra Gateway Company], Commercial Registration No. [●], based in Riyadh ("we", "us" or the "Platform"). We provide an online bidding service for camels. • All camels offered on the Platform are sold by a single seller, Qawafel Alsahra Auctions Company, Commercial Registration No. [●] (the "Seller"), as owner of the camels or as agent of their owner under an auction agreement. • The Seller is a separate entity from us. The sale contract is made directly between you and the Seller, and we are not a party to it. • Each auction has its own "Auction Sale Terms", which you accept before bidding in it. If they conflict with these Terms on any matter relating to the sale, the Auction Sale Terms prevail.
